WHAT ARE NARCOTIC DRUGS?

There are over 75 narcotic drugs defined in 13-3401. The most common are heroin, cocaine, opium, morphine, and oxycodone. All charges involving a narcotic drug are classified as felonies. The following table contains subsections of the narcotic drug statute and their corresponding felony levels and associated incarceration lengths.

These punishments are only for non-dangerous, non-repetitive felony charges. In addition to jail or prison, a convicted drug offender may be required to pay fines, complete community restitution hours, and serve a possible term of probation. Probation may be mandatory for certain drug offenses.
